Premium Terms

1. Introduction:
This Premium Terms agreement ("Premium Terms") governs your purchase and use of premium products and services offered through Hostiva.tech ("Hostiva," "we," "our," or "us"). These Premium Terms are in addition to our general Terms of Use and apply specifically to premium offerings.
By purchasing or using any premium products or services, you agree to be bound by these Premium Terms. If you do not agree to these Premium Terms, please do not purchase or use our premium offerings.
2. Premium Offerings
2.1 Types of Premium Offerings
Hostiva offers various premium products and services, including but not limited to:
- Premium AI Solutions: Enhanced versions of our AI tools with additional features and capabilities
- Enterprise Plans: Customized solutions for larger organizations with specific requirements
- Priority Support: Expedited customer service and technical assistance
- Advanced Analytics: In-depth data analysis and reporting tools
- White-Label Options: Ability to rebrand our solutions with your own branding
- API Access: Programmatic access to our platform's capabilities
- Extended Storage: Increased data storage capacity
2.2 Feature Limitations
The specific features, limitations, and capabilities of each premium offering are described on the respective product or service page. We reserve the right to modify the features of any premium offering with reasonable notice to subscribers.
3. Subscription Terms
3.1 Subscription Period
Premium subscriptions may be offered on a monthly, quarterly, annual, or custom basis as specified in your purchase agreement. The subscription period begins on the date of purchase and continues for the duration specified in your plan.
3.2 Automatic Renewal
Unless otherwise specified, premium subscriptions automatically renew at the end of each subscription period. You will be charged according to your selected payment method at the then-current rate for your subscription plan.
3.3 Cancellation of Automatic Renewal
You may cancel the automatic renewal of your subscription at any time through your account settings or by contacting our customer support. Cancellation will take effect at the end of your current billing period.
4. Pricing and Payment
4.1 Pricing
Prices for premium offerings are listed on our website or in your custom quote. All prices are subject to change with notice provided at least 30 days in advance of any price increase.
4.2 Payment Methods
We accept various payment methods as indicated during the checkout process. By providing a payment method, you represent that you are authorized to use the payment method and authorize us to charge your payment method for all fees associated with your premium subscription.
4.3 Taxes
Prices for premium offerings do not include applicable taxes. Any taxes that we are obligated to collect will be added to your total amount due.
5. Usage Limitations
5.1 Fair Usage Policy
Premium offerings may be subject to fair usage limitations as specified in the product description or your service agreement. Excessive usage beyond reasonable limits may result in additional charges or service limitations.
5.2 API Rate Limits
If your premium offering includes API access, usage is subject to rate limits as specified in our API documentation. Exceeding these limits may result in temporary service throttling or additional charges.
5.3 User Limits
Premium subscriptions may specify a maximum number of authorized users. You agree not to exceed this limit without upgrading your subscription accordingly.
6. Enterprise Customization
6.1 Custom Development
For enterprise customers, we may offer custom development services to tailor our solutions to your specific needs. Such customization is subject to:
- A separate statement of work detailing the scope, timeline, and deliverables
- Additional fees as specified in your custom quote
- Acceptance criteria as defined in your agreement
6.2 Ownership of Customizations
Unless otherwise specified in your enterprise agreement:
- Hostiva retains ownership of all intellectual property rights in the core platform and any customizations
- You receive a non-exclusive license to use the customized solution for the duration of your subscription
- Custom code developed specifically for your implementation may be subject to different ownership terms as specified in your agreement
7. Service Level Agreement (SLA)
7.1 Availability Commitment
For premium subscribers, we commit to a platform availability of 99.9% measured on a monthly basis, excluding scheduled maintenance.
7.2 Support Response Times
Premium subscribers receive priority support with the following target response times:
- Critical issues: Within 2 hours
- High-priority issues: Within 4 hours
- Medium-priority issues: Within 1 business day
- Low-priority issues: Within 2 business days
7.3 SLA Credits
If we fail to meet our SLA commitments, you may be eligible for service credits as specified in your subscription plan. To receive credits, you must submit a request within 30 days of the incident.
8. Termination
8.1 Termination by You
You may terminate your premium subscription at any time by canceling the automatic renewal and discontinuing use of the premium offerings. Refunds for early termination are subject to our Refund Policy.
8.2 Termination by Us
We may terminate your premium subscription for cause if you materially breach these Premium Terms, the general Terms of Use, or any other applicable agreement. In such cases, no refund will be provided.
8.3 Effect of Termination
Upon termination of your premium subscription:
- Your access to premium features will cease at the end of your current billing period
- Any data specific to premium features may be deleted after 30 days
- You will revert to standard access levels if applicable
9. Changes to Premium Terms
We may update these Premium Terms from time to time. We will notify premium subscribers of any material changes via email or through the platform. Your continued use of premium offerings after such notification constitutes acceptance of the updated Premium Terms.
