1. Introduction
Hostiva.tech ("Hostiva," "we," "our," or "us") respects the intellectual property rights of others and expects users of our platform and services to do the same. This Copyright Policy outlines our procedures for addressing claims of copyright infringement in accordance with the Digital Millennium Copyright Act ("DMCA") and other applicable intellectual property laws.
2. Reporting Copyright Infringement
If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible via the Hostiva platform, please notify Hostiva's designated Copyright Agent as set forth below.
For your complaint to be valid under the DMCA, you must provide the following information in writing:
1. Identification of the copyrighted work that you claim has been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
2. Identification of the material that you claim is infringing or is the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit Hostiva to locate the material (e.g., URL of the page containing the material).
3. Your contact information, including your address, telephone number, and an email address.
4. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
5. A statement that the **information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner.
6. A physical or electronic signature of a person authorized to act on behalf of the owner of the copyright that has been allegedly infringed.

UNDER FEDERAL LAW, IF YOU KNOWINGLY MISREPRESENT THAT ONLINE MATERIAL IS INFRINGING, YOU MAY BE SUBJECT TO CRIMINAL PROSECUTION FOR PERJURY AND CIVIL PENALTIES, INCLUDING MONETARY DAMAGES, COURT COSTS, AND ATTORNEYS' FEES.
3. Counter-Notification Procedures
If you believe that material you posted on the site was removed or access to it was disabled by mistake or misidentification, you may file a counter-notification with us (a "Counter-Notice") by submitting written notification to our Copyright Agent (identified above).
Pursuant to the DMCA, the Counter-Notice must include substantially the following:
1. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access disabled.
2. Your contact information, including your name, address, telephone number, and email address.
3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
4. A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if you reside outside the United States for any judicial district in which Hostiva may be found) and that you will accept service of process from the person who provided the original infringement notification or an agent of such person.
5. Your physical or electronic signature.
Upon receipt of a valid Counter-Notice, the DMCA permits us to restore the removed content if the party filing the original DMCA notice does not file a court action against you within ten (10) business days of receiving the copy of your Counter-Notice.
Please note that under Section 512(f) of the Copyright Act, any person who knowingly materially misrepresents that material or activity was removed or disabled by mistake or misidentification may be subject to liability.
4. Repeat Infringers
In accordance with the DMCA and other applicable law, Hostiva has adopted a policy of terminating, in appropriate circumstances and at Hostiva's sole discretion, users who are deemed to be repeat infringers. Hostiva may also at its sole discretion limit access to the platform and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
5. Modifications
Hostiva reserves the right to modify this Copyright Policy at any time. Any changes will be effective immediately upon posting the revised policy on our website. Your continued use of the platform after such changes constitutes your acceptance of the new policy.
